RAPID CITY, S.D. (KEVN) - Derrek Brave Heart is accused of shooting and killing a man outside of Family Dollar on Haines Avenue following an argument in February. Brave Heart appeared in court Thursday for an evidentiary hearing in which multiple witnesses testified against him. These witnesses included an engaged couple who witnessed the shooting, the police officer who arrested Brave Heart, and Brave Heart’s ex-girlfriend.

Each witness told a similar story, alleging a man named John Odom approached Brave Heart’s car and began arguing with him. Odom reportedly slapped Brave Heart at least three times during the confrontation. Brave Heart reportedly asked a bystander “Am I in the wrong?” to which the bystander replied “No.”

Following a third slap, which witnesses described as the hardest, Brave Heart allegedly pulled out a gun and fatally shot Odom.

If convicted of second-degree murder, Brave Heart will face life in prison.
