Rapid City murder case hits a snag

The defense argues that Sierra did not understand Miranda rights when read to him while the prosecution disagrees.

RAPID CITY, S.D. (KEVN) - Duane Sierra, 22, was charged with first-degree murder back in May of 2023 when Serena Ann Spider was found on Lacrosse Street with a gunshot wound.

On Tuesday, April 30, Sierra and counsel from both sides appeared in court to address a motion to strike his statements from court records. The reason for this motion is the defense believes that Sierra did not understand his Miranda rights when read to him while the prosecution argues he did.

Both sides presented questions to the investigators responsible for the case before Judge Jane Pfiefle called the court into recess to examine the evidence presented.

Sierra’s trial is set for May 13 and he faces a maximum sentence of life in prison if convicted.
